Terms of Service

1. These Terms and Conditions are continuously available at https://paintspace.online/ in a manner that allows users to access, reproduce, and store them — in particular by printing or saving to a device at any time. The document outlines the general terms and conditions for concluding and executing sales agreements via the online store, including delivery and payment methods, the rights and obligations of the Customer and the Seller, withdrawal procedures, and the complaint process. It also provides information on alternative dispute resolution methods and regulations concerning electronic services provided by the Seller.

2. The administrator of personal data collected through the online store is Renata Kucharska, conducting business under the name Renata Kucharska Malarstwo i Ty, registered in the Central Registration and Information on Business (CEIDG). 3. In accordance with the provisions of the Polish Consumer Rights Act of May 30, 2014, the Consumer may not waive the rights granted under this Act. If any provision of these Terms and Conditions is less favourable to the Consumer than the applicable legal regulations, the statutory provisions shall prevail.

  1. Personal Data Administrator – the Seller.
  2. Order Fulfilment Time – the period from the moment the order is confirmed by the Seller until the ordered product is delivered to the Customer.
  3. Business Day – a day from Monday to Friday, excluding public holidays in Poland.
  4. Course – educational content in electronic format, intended for viewing using appropriate software on digital devices (e.g., smartphones, tablets). Courses available in the store may be delivered as downloadable digital files, via newsletter, or as part of a membership.
  5. Fanpage – a page managed by the Seller on the Facebook platform, used for communication with users.
  6. Contact Form – an electronic service that enables the Customer to contact the Seller via a form available in the online store.
  7. Registration Form – an electronic service that allows the Customer to create an account using a form available in the online store.
  8. Electronic Service “Notify About Availability” – a form that enables the Seller to send an email to the Customer with information about the availability of a specific product.
  9. Order Form – an electronic service that allows the Customer to place an order, in particular by adding products to the cart and specifying the terms of the sales agreement, including the payment method.
  10. Password – a string of characters set by the Customer during registration, used to secure access to the account.
  11. Customer – a natural person, legal entity, or organizational unit without legal personality who:  a) has entered into or intends to enter into a sales agreement with the Seller,  b) uses electronic services provided by the Seller.
  12. Civil Code – the Act of April 23, 1964 – Civil Code (Journal of Laws 1964 No. 16, item 93, as amended), hereinafter also referred to as “CC.”
  13. Consumer – a natural person who enters into a legal transaction with the Seller that is not directly related to their business or professional activity.
  14. Customer Account – an electronic service, an individual panel available to the Customer, where their data and order history are stored.
  15. Cart – a component of the store’s software where the products selected by the Customer for purchase are displayed, and where order details, especially product quantities, can be modified.
  16. Newsletter – an electronic service provided by the Seller via email, allowing the Customer to subscribe and automatically receive periodic, free updates, including information about new products and promotions.
  17. Entrepreneur – a natural person, legal entity, or organizational unit without legal personality, granted legal capacity by law, conducting business or professional activity in their own name.
  18. Individual Entrepreneur – a natural person entering into an agreement with another entrepreneur directly related to their business activity, but not of a professional nature. Such individuals are subject to consumer protection laws regarding unfair contract terms, statutory warranty, and the right to withdraw from distance or off-premises contracts.
  19. Terms and Conditions – this document outlining the rules for using the blog and online store paintingandyoublog.test/.
  20. Online Store – the website available at paintingandyoublog.test/, through which the Seller offers goods and services for sale.
  21. Goods/Product – services (e.g., courses) and physical goods (e.g., paintings) available in the online store, which are the subject of the sales agreement between the Customer and the Seller.
  22. Sales Agreement – a distance contract concluded between the Customer and the Seller via the online store, concerning the sale of goods or services.
  23. Distance Contract – a contract concluded without the simultaneous physical presence of the parties, using remote communication methods.
  24. Electronic Service – a service provided electronically by the Seller to the Customer via the online store.
  25. Consumer Rights Act – the Act of May 30, 2014 on consumer rights (Journal of Laws 2014, item 827, as amended).
  26. Order – a declaration of intent by the Customer, submitted via the order form available in the store, aimed directly at concluding a sales agreement.
  27. Electronic Service “Product Inquiry” – a form that enables the Customer to contact the Seller to obtain information about the availability or specifications of a given product.
  28. Electronic Service “Reviews” – a form that enables the Customer to submit a product review on the online store’s website.
  29. Electronic Service “Send to a Friend” – a form that enables the Customer to send a product recommendation via email to another user.
  1. The Customer is obliged to use the online store and all services offered by the Seller in accordance with the applicable laws of the Republic of Poland, the provisions of these Terms and Conditions, and with respect for social norms, personal rights, and the copyrights and intellectual property of the Seller and third parties.
  2. These Terms and Conditions are addressed to both Consumers and Entrepreneurs, including Individual Entrepreneurs, who use the online store.
  3. Customers’ personal data is processed in accordance with the principles set out in the Privacy Policy and the Information Clause for Customers, compliant with Article 13 of the GDPR. These documents are continuously available on the store’s website.
  4. The Privacy Policy also contains information regarding the conditions for collecting, processing, and protecting personal data by the Seller.
  5. Consent forms (so-called checkboxes) related to the processing of Customers’ personal data are available on the store’s website wherever data is collected. The content of each consent must be accepted by the Customer. The Customer has the ability to update, modify, or withdraw their consents at any time.
  6. By placing an order, the Customer consents to the collection, storage, and processing of their personal data provided on the store’s website by the Seller. This data may be shared with third parties only in two cases:  

    a) for the purpose of fulfilling and completing the order,  
    b) in connection with the operation of the paintingandyoublog.test/ website, based on a data processing agreement with the hosting provider.

    Information about entities to whom data is disclosed is available in the Privacy Policy.
  7. All information contained in the Seller’s online store does not constitute an offer within the meaning of Article 66 of the Civil Code, but rather an invitation to conclude a contract as defined in Article 71 of the Civil Code.
  8. Use of the online store refers to any activity by the Customer/User aimed at viewing the content published on the store’s website.
  9. To ensure the security of electronic communications and digital content, the Seller implements and applies appropriate technical and organizational measures.
  10. The Seller informs that the use of electronic services and the public nature of the Internet may involve risks such as:  

    – unauthorized access to and modification of data,  
    – installation of malicious software on the Customer’s device.  

    The Customer should use appropriate technical safeguards to minimize these risks.
  11. The Seller reserves the right to organize occasional promotional campaigns and contests. Their terms and conditions are published on the store’s website each time. Promotions cannot be combined unless stated otherwise in the specific promotion’s terms.
  12. The minimum technical requirements necessary to interact with the Seller’s IT system and use the online store are:  

    a) a computer, laptop, or other multimedia device with Internet access,  
    b) a web browser that supports cookies,  
    c) access to an active email account.
  1. The Seller enables contact with the Customer through the following channels:  

    a) by phone – at +48 506 033 532,  
    b) by email – at contact@paintingandyou.blog.
  2. Browsing the store’s assortment does not require creating a Customer account.
  3. The sale of goods and services available in the store is based on an order placed by the Customer.
  4. The Customer may place an order immediately after creating a Customer account.
  5. Access to certain website functionalities may require prior registration and login. Use of the store’s features is voluntary.
  6. For the proper functioning of the store and the Customer account, enabling cookies in the web browser may be required.
  7. Costs related to Internet access and data transmission are borne by the Customer, in accordance with the rates of their Internet service provider.
  8. The Customer is responsible for the authenticity and completeness of the data entered in the forms available in the store.
  9. The online store provides free electronic services such as: Customer account, registration form, membership, contact form, order form, newsletter, course summary in PDF file, certificate of course completion, product inquiry, reviews, send to a friend. The Seller will inform users on the store’s website of any interruptions in the provision of these services.
  10. The Customer has the right to submit a complaint regarding electronic services provided by the Seller. Complaints may be submitted:

    a) in writing – to the Seller’s registered address,  
    b) by email – to contact@paintingandyou.blog.
  11. It is recommended that the complaint include a description of the issue and the Customer’s contact details.
  12. The Seller will respond to the complaint promptly, no later than within 14 calendar days of receiving it.
  13. The Customer, for whom the Seller provides continuous and indefinite electronic services (e.g., Customer account), has the right to terminate the service agreement at any time, without providing a reason. Termination may be submitted electronically or in writing.
  14. The Seller has the right to terminate the agreement for continuous and indefinite electronic services with 14 days’ notice if the Customer violates the provisions of these Terms and Conditions.
  1. A Customer account is created by completing the registration form available in the online store. The form requires the submission of necessary personal data.
  2. Additional data that the Customer may enter in the account’s admin panel is used to place orders in the store when filling out the order form.
  3. Registration of a Customer account in the store is free of charge.
  4. The account service is provided for an indefinite period.
  5. To register and create an account, the following conditions must be met:

    a) consent to the Terms and Conditions, which the Customer can review directly while completing the form,  
    b) consent to the processing of personal data provided in the registration form.

  6. After submitting the registration form, the Customer receives confirmation of registration from the Seller at the email address provided. To log in to the account, the Customer must enter the login and password set during registration. Once logged in, the Customer has the ability to:  

    – edit their personal data,  
    – check the status of orders,  
    – view order history.
  7. The Customer has the right to delete their account at any time, without providing a reason and without incurring any fees. Account deletion is carried out by submitting a request to the Seller, particularly via email.
  1. Users may create a personal account to access selected course materials, track progress, and participate in community features. Registration is free and optional, but may be required to access certain content or services. Full access to purchased online courses is paid and granted for a specified period — from two to three months, depending on the selected plan.
  2. Access to the first lesson of each course is free of charge and not conditional upon subscribing to the newsletter. Users may obtain access either by registering an account or by subscribing to the newsletter. This free lesson is part of the general offer and does not constitute a reward or incentive for providing personal data.
  3. If the Customer is a consumer from the European Union, they have the right to withdraw from the purchase agreement for a physical product within 14 days of receiving it. The right of withdrawal does not apply to digital products or membership if the Customer has agreed to begin the service before the withdrawal period ends and has been informed of the loss of the right to withdraw upon gaining access.
  4. The account holder is responsible for maintaining the confidentiality of login credentials and for all activities that occur under their account.
  5. We reserve the right to suspend or terminate accounts that violate these Terms of Service or engage in abusive or fraudulent behaviour.
  6. Returns are possible in the following cases:  

    Physical products: in case of damage or discrepancy with the order, reported within 7 days from the delivery date.  
    Digital products and membership: no possibility of return after access has been granted, in accordance with the Customer’s expressed consent. To request a return, please contact the support team and provide your order details.
  1. Users may subscribe to our newsletter to receive updates, educational content, promotional offers, and news related to Painting & You.
  2. Subscription is voluntary and may be terminated at any time by clicking the “unsubscribe” link included in each email or by contacting us directly.
  3. By subscribing, users consent to the processing of their personal data in accordance with our Newsletter GDPR Notice.
  4. Access to the first lesson of each course is free of charge and not conditional upon subscribing to the newsletter. Users may obtain access either by registering an account or by subscribing to the newsletter.
  5. This free lesson is part of the general offer and does not constitute a reward or incentive for providing personal data.
  6. We reserve the right to modify the content or frequency of the newsletter at any time.
  1. The service consists of providing the Customer with a summary of a selected painting course in PDF format, which can be downloaded to the Customer’s device upon completion of the course.
  2. The PDF file contains condensed information about the course content, its structure, topics, and key issues discussed during the sessions. It serves as a summarizing and educational resource.
  3. The service is provided free of charge exclusively to Customers who have purchased full access to the course and have met the completion requirements specified by the Seller.
  4. The PDF file is made available via a download link, which may be sent to the Customer’s email address or accessible in the user panel on the store’s website.
  5. The Customer is obliged to use the file solely for personal and educational purposes. Copying, distributing, or sharing the file with third parties without the Seller’s written consent is prohibited.
  6. Upon downloading the PDF file, the service is considered fully performed, which excludes the possibility of withdrawal from the agreement in accordance with Article 38 point 13 of the Consumer Rights Act.
  1. The service consists of generating and providing the Customer with a certificate of completion for a painting course in PDF format, upon fulfilment of the specified course completion requirements.
  2. The certificate includes the Customer’s name and surname, the course title, completion date, and other details confirming participation and completion of the course program.
  3. The service is provided free of charge to Customers who have purchased full access to the course and met the completion requirements specified by the Seller.
  4. The certificate is made available via a download link or sent to the Customer’s email address.
  5. The document is for informational purposes only and does not constitute an official document or professional certification.
  6. Upon generation and delivery of the certificate, the service is considered fully performed, which excludes the possibility of withdrawal from the agreement in accordance with Article 38 point 13 of the Consumer Rights Act.
  1. The “Send to a Friend” electronic service is provided free of charge and is concluded for a fixed period — from the moment the form is used until the message is sent.
  2. The Seller enables the Customer/User to send an email message via an interactive form, recommending a specific product to another potential Customer’s email address.
  3. To use the service, click the envelope icon next to the product, enter the recipient’s name and email address, then click the “Send” button. A message containing a link to the recommended product’s subpage will be sent to the provided address.
  4. The Customer/User may cancel the use of the service at any time by choosing not to complete the form or by closing the form window.
  5. The service does not involve storing the recipient’s data in the Seller’s database, and the message sent is one-time and informational in nature.
  1. The “Reviews” electronic service is provided free of charge.
  2. The Seller allows Customers/Users to submit reviews of products available in the online store, particularly those they have purchased.
  3. To use the service, the Customer must complete the electronic form located directly beneath the description of the relevant product.
  4. Only Customers with an account in the online store may use this service. To do so, they must log in to their account and submit a review via the form provided next to the product.
  5. The service is provided for a fixed period — from the moment the review is started until it is either submitted or the Customer decides not to proceed.
  1. All prices displayed on the website are expressed in euros (EUR) and are gross prices. The Seller benefits from a VAT exemption under Article 113 of the Polish Act on Goods and Services Tax.
  2. Customers making purchases from within the territory of the Republic of Poland have the option to pay in Polish zloty (PLN). In such cases, the amount will be automatically converted by the payment operator (Stripe) according to the current exchange rate.
  3. The Seller reserves the right to change prices and the currency in which prices are displayed. These changes do not affect orders placed prior to their implementation.
  4. Information about the currency and the total amount payable is always presented to the Customer before finalizing the order.
  1. The electronic service “Order Form” is free of charge and intended for one-time use.
  2. Orders via the online store can be placed 24 hours a day, 7 days a week.
  3. An order is placed by completing the order form available on the store’s website.
  4. The agreement is concluded for a fixed term — it begins when the Customer adds the first course to the electronic cart and ends either upon abandoning the order form or upon submitting it by clicking the button confirming the purchase and the obligation to pay the price.
  5. The Customer has the opportunity to review the Terms and Conditions and the Privacy Policy before deciding to enter into the agreement or make changes to the order.
  6. The procedure for concluding a sales agreement involves selecting a course and performing technical actions in accordance with the prompts and information displayed on the store’s website during the ordering process. The order is placed by clicking the button confirming the purchase and the obligation to pay the price.
  7. Only Customers logged into their account in the online store may make a purchase.
  8. After selecting courses and completing the order, the Customer accepts the Terms and Conditions, confirms having read the Privacy Policy and the notice regarding the right to withdraw from the agreement, and then places the order by clicking the “Buy and Pay” button.
  9. Until the “Buy and Pay” button is clicked, the Customer may edit the order.
  1. Courses are made available to the Customer upon receipt of payment.
  2. The Seller offers the following payment method for ordered products:

    – Stripe Payments Europe, Ltd., The One Building, 1 Grand Canal Street Lower, Dublin 2, Ireland.
  3. Detailed information regarding available payment methods is provided on the online store’s website.
  4. If payment is not made within the specified timeframe, the order will be cancelled.
  1. Purchased artworks (gouache paintings) are shipped individually, with care and proper protection. Each shipment is prepared manually and dispatched via a selected courier service (e.g. DHL, UPS, DPD), according to the delivery address provided by the Buyer.
  2. The order is usually processed within 3 to 7 business days after payment is received. Shipping costs are added to the product price and shown in the cart before checkout.
  3. Once the shipment is dispatched, the Buyer will receive a tracking number via email.
  4. Copyright notice:

    – In accordance with applicable copyright law, this offer concerns the sale of the original physical artwork only. The right to reproduce, publish, or commercially use the work is not included. All economic copyright rights remain the property of the artist and may be subject to a separate agreement.
  1. A sales agreement between the Customer and the Seller is concluded after the Customer places an order via the order form available in the online store and the Seller accepts the order.
  2. Placing an order requires a valid email address.
  3. After placing the order, the Customer receives an automatic confirmation of receipt sent to the provided email address. This confirmation does not yet constitute the conclusion of the sales agreement.
  4. The agreement is concluded when the Customer receives an email confirming that the order has been accepted for processing and that payment has been received.
  5. The Seller reserves the right to refuse to process an order in justified cases, particularly if the order is not paid within the specified timeframe or if incorrect contact details are provided.
  1. In the case of digital product sales (online courses), the service is provided immediately after purchase and payment confirmation.
  2. Pursuant to Article 38 point 13 of the Polish Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827, as amended), a Customer who is a Consumer does not have the right to withdraw from an agreement concerning the delivery of digital content not recorded on a tangible medium, if: a) the Consumer has consented to the commencement of service before the withdrawal period has expired, b) the Consumer has been informed about the loss of the right to withdraw from the agreement.
  3. By making a purchase, the Consumer consents to the immediate commencement of service by selecting the appropriate checkbox and is informed about the loss of the right to withdraw from the agreement.
  1. The Seller undertakes to provide the Customer with: a) an online course that matches the order, is fully accessible, and free from technical errors that would prevent use of the service, b) a physical product (e.g., artwork) that matches the order and is free from physical and legal defects.
  2. In the event of non-compliance of the product with the agreement, the Customer has the right to file a complaint in accordance with the provisions of:

    – the Consumer Rights Act of May 30, 2014,
    – the Civil Code, in particular Articles 556–576.
  3. The Seller is liable: a) for non-compliance of digital content with the agreement, if the course is provided incorrectly, incompletely, or fails to function, b) for physical or legal defects in the physical product, especially if the product is damaged, incomplete, or inconsistent with its description, except in cases where such damage occurred due to the fault of the carrier, third parties not affiliated with the Seller, or as a result of force majeure.
  4. The Customer may submit a complaint in any form, in particular:

    – in writing to the Seller’s registered address,
    – electronically to the Seller’s email address.
  5. To facilitate the complaint process, it is recommended (though not required) that the Customer provide the following information: a) contact details of the person submitting the complaint, b) date of purchase of the product and date of complaint submission, c) description of the issue being reported, d) preferred resolution (e.g., restoration of access, product replacement, refund).
  1. The Seller provides services consisting of granting access to purchased painting and drawing courses in electronic form via the online store. The courses are original works and are protected under copyright law.
  2. Courses may include interactive elements created using digital tools offered by h5p.org and other solutions available under Creative Commons licenses, including functionalities available through the WordPress.com Business Plan. Details regarding sources and bibliography are provided on the course page.
  3. The Customer is entitled to use the purchased courses solely for personal use, in accordance with applicable laws and the provisions of these Terms and Conditions.
  4. Access to the courses is granted to the Customer upon completion of the purchase, either directly on the store’s website or through the Customer’s account panel, as part of the membership service.
  5. The Customer is not permitted to: a) distribute the courses in any form, whether for commercial or non-commercial purposes, unless explicitly permitted by law, b) copy, modify, publish, or use the courses, in whole or in part, for any purpose other than personal use, c) share the courses with third parties, including by transmitting, publishing online, or sharing account access credentials.
  6. Violation of the rules outlined in point 5 may result in civil or criminal liability, in accordance with the Polish Copyright and Related Rights Act of February 4, 1994.
  1. The Seller informs that detailed information regarding out-of-court methods for resolving complaints and pursuing claims, as well as access procedures, is available:

    – through consumer protection organizations (e.g., Consumer Federation),
    – at Provincial Inspectorates of Trade Inspection,

  2. A Customer who is a Consumer has the right to use out-of-court dispute resolution methods, in particular:

    a) submit a request for dispute resolution to a permanent consumer arbitration court (pursuant to Article 37 of the Trade Inspection Act),
    b) request mediation proceedings from the provincial inspector of Trade Inspection,
    c) seek free assistance from a district (municipal) consumer ombudsman or a consumer protection organization, d) use the EU-level Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr
  3. Use of out-of-court dispute resolution methods is voluntary and available after the complaint procedure has been completed.
  4. The Seller declares compliance with applicable laws regarding the protection of personal data of individuals using the online store.
  5. Detailed rules for personal data processing, including purposes, scope, and rights of data subjects, are specified in the Privacy Policy available on the store’s website.
  6. Providing personal data is voluntary; however, failure to provide data necessary for concluding a sales agreement may prevent its conclusion.

  1. The Seller declares compliance with applicable laws concerning the protection of personal data of individuals using the online store.
  2. Detailed rules for the processing of personal data, including the purposes, scope, and rights of data subjects, are specified in the Privacy Policy available on the store’s website.
  3. Providing personal data is voluntary; however, failure to provide data necessary for concluding a sales agreement may prevent its conclusion.
  1. Agreements are concluded in English via the online store.
  2. Matters not regulated by these Terms and Conditions are governed by generally applicable provisions of Polish law.
  3. Attachments to the Terms and Conditions constitute an integral part of the document.
  4. The Seller reserves the right to make changes to the Terms and Conditions. The Customer will be informed of any changes at least 14 days in advance by receiving a link to the updated provisions via electronic communication. Changes take effect 14 days after their publication on the store’s website.
  5. If the Customer does not accept the changes, they must notify the Seller within 14 calendar days. In such cases, the agreement will be terminated. Lack of objection constitutes acceptance of the changes.
  6. Changes concerning electronic services (e.g., Customer account, order form) are binding if the Customer has been properly informed and has not terminated the agreement within 14 days of notification.
  7. Changes to the Terms and Conditions do not affect orders placed before their effective date or orders currently being processed.
  8. These Terms and Conditions enter into force on December 2, 2025.
